I don't know much about Australia but I can give a sample situation. One could get Australian PR, live there for two years, get citizenship, apply for a job in the US and enter on an E3 visa which is renewable every two years and allows one's spouse to work.

I cannot believe there are 9 pages (and counting) worth of sentiments, because some lame talentless guy was subject to security checks at an International Airport. I'm someone who was born India, but never lived there - however I'd think there are incredibly talented Indians here in America and worldwide compared to someone who's used to blatant exploitation / sell out of Indian culture. 8000 Indians (almost the complete 7% ANNUAL limit for I485) were PERM certified in the first quarter of fiscal 2007 (oct-dec 2006) itself! No wonder we have big backlogs for India...

shows that 80K cases were filed, and of these 36K certified. Assuming of the 23K rejections 14K were appealed and then got through, that means only 50K PERM approvals in the whole year. As dates retrogress in the future, and slowly start moving again, they should hopefuly cross this march-2005 to march-2006 timeframe fairly fast... Some of these I140s would have gotten denied, some of these cases possibly abandoned (no substitution also now!), and some I485s would get caught in namechecks and what not..

Sachug, it is a great attempt to compare the quarterly and annual spill overs. I made rough calculations couple of weeks ago with annual spill over. However, I assumed around 25K ROW visas(both pending and new) for EB2. And assumed only aroudn 125K for AOS keeping 15K for CP. I will compile all of my assumptions and post here. Overall, my calcs estimated EB2 move to Dec 2006. By the way, I hope you took China in to consideration for spill over.
My numbers
EB1 all - 17K
EB2 ROW - 22K
EB2-I 30K
EB2-C 9K
EB3 all - 40K
EB4 all - 7K
EB5 all - 7K
CP - 8K

My point is not to discourage any one, but when we wirte to media, folks will investigate all before they publish to main stream. We need to be fair and should provide the correct information, else we might loose the coverage.

7 pages of this and I don't think there is any clear information on how many applied betweek Jan and April-1 of 2005. I saw a post somewhere where someone said Cisco alone had about 1000 applications. Now if you add dependents to it that is almost a years quota of EB2,just from Cisco!!! I think easily there are around 5000 EB2 applicants in just that time frame. My 2 cents.
When it took about 2 years spill over visas (2008 and 2009) for the EB2 India dates to move from April 2004 to Jan 2005, I am sure you could estimate how long it would take to cross a year.

H1b cap is 65k+ 20K for US master degree and remaining are exemptions. Total approimately 125K were issued on 2007.
You mean the cap-exempt made up 50K ? That appears too high. What is your source of info.

If you aren't going to be in US, even if you have an agent, there's is a risk that they might call you up for an interview you may not be able to go to.
If you are hard-up on info and don't want to go thro' headache, try one of the reputed ones.. stay away from WWICS..
For couple of thousand.. if you can get little help and good advise, it's not bad.. but most of these shops are akin to Desi consultants in USA. Lie, Cheat and make money .. that's the mission statement..
Apart from that.. process and forms are on the web. Tricky part is getting a job and living in Canada .. It's a honduras with worse looking people..

Hello this question is for Lawyer, i will like to find out how can somebody find out if the I 140 is been revoked by the old employer.
Please help me out i will like to find out the way to find out as my employer told me he will revoke my I 140 but have not got any information from USCIS aslo the the online status shows case approved in sep 2006.
Please let me know if it is revoke would Uscis send a letter or the online system would say any changes online.

Yes, I wonder too. The new memo with the 180 day rule for FBI name check may create a considerable demand for visa numbers and could slow things down.
If the current EB3-ROW move is any indication one can rely on, I think you will be current in next month's bulletin. I bet you can't wait.

Not sure if it was answered anywhere for similar situation..
Here is my situation. I would like to see my options:
1) I am on H1B (7th year and got extended for 3 yrs) and applied 485, received EAD from company A (140 approved).
2) Applied 485 for wife and kid and got EAD last July.
3) Category is EB3-I PD of Apr 06.
4) Though I was eligible for EB2 (13 yrs exp before joining company A) becas of Company A (they decided not to open EB2 position at that time). I was forced to go to EB3.
5) I am getting offer from my client and my company has agreed me to support. but client won't do H1 so I have to use EAD
6) in this case, can I get a another company (for future employment) to file for my GC on EB2? Will they be able to do it without H1 to them?
7) if so what would be the implications?

Somebody suggested earlier that we should all contact our lawyers , and ask why they have not filed lawsuits yet.
I think the reason for this is quite simple. Lawyers are happy with the current system, so that they can continue to charge money, consulting fees etc.
Do you guys really think lawyers care about it? They are happy charging $200 for a 15 minutes consultation.
I have nothing against the lawyers, they are running a business and need to maximize profit.

Well discussion here. Under present situation (w/o any legislative relief) labor certification based EB folks, particulary Indians, cannot think of GC/485 for next 10 years. The problem here is, they are stopping the flood gate in 485 stage. If they (CIS/DOS) do not need high skilled immigrants, stop them in LC stage itself. Testing labor market in 2001, for a permanent job that is going to be assumed by a foreign worker only in (after 485 approval) 2010 is a joke. The best slution is market based numarical limitation without any country quota.
Yeah its a joke and it is obvious to us that there should be legislation to fix this. However the current situation is so beneficial to the US that it may be stupid for them to try and fix it. The lack of immigrant visas isn't bringing anything down. Fresh H1B and L1 workers will continue to pour into the country and "old, stale, spent, burnt out, balding" workers will leave the country frustrated with the wait. The scientists and executives whose experience is useful to have will get into EB1 slots and stay.
So two choices
1. Lets continue to pay income tax, pay social security tax, spend the prime of our lives working here and then GET OUT when we are no longer needed.. OR..
2. Lobby hard, for which we should contribute some serious money to IV. Whats holding back the EB3 folks?? the doors are almost closed for them. They should be contributing in large numbers..
EB2 Ind & Chi.. if dates dont move for April (new calendar quarter), we better start contributing too
